Welcome to Union Telecom: This document constitutes the Agreement to use Union Telecom’s long distance telephone service. Please read and keep this agreement and abide by its terms. When you use Union Telecom’s service you agree to the terms of this Agreement. The terms “Customer”, “you” and “your” refer to the person that requested the service and paid for the initial deposit to open the account with Union Telecom.
About this document: This is a legal agreement. By subscribing to or using Union Telecom’s service, Customer accepts and agrees to be bound by all terms and conditions of this agreement. This document contains the terms and conditions of use applicable to long distance services provided by Union Telecom to commercial and residential customers. The terms and regulations contained in this document apply only to services furnished by Union Telecom and do not apply, unless otherwise specified, to the lines, facilities or services provided by local exchange carrier or other common carrier for use in accessing Union Telecom’s services.
Billing Statements / Amount Due: Union Telecom will remit invoices for all charges to the Customer listed as the owner of the account or alternatively to the person and address designated by the Customer to receive the bill at the mailing or e-mail address provided by the Customer. Customer must notify Union Telecom immediately of any change in the mailing or e-mail address to which Union Telecom sends the billing statements. Customer agrees and consents that Union Telecom may update Customer’s billing address if it receives information that your billing address has changed or is incorrect. Each billing statement will include a previous balance, current charges, taxes and other charges and total amount due.
Credit Limit: Each new Customer will be eligible to receive, at the sole discretion of Union Telecom, an initial credit line of up to $100 if Union Telecom can verify the information you provided, you continue to meet Union Telecom’s selection criteria, you are at least 18 years old, you live in the United States of America, your initial set-up fee has been credited to our account, you have not had an account in default with Union Telecom over the past 2 years, and you meet the other criteria bearing on creditworthiness established by Union Telecom prior to approval as a customer. The credit limit on your account may be increased or decreased, at the sole discretion of Union Telecom, upon review of your account history, payment history with Union Telecom and other relevant criteria. The use of Union Telecom service, either billed or unbilled, will reduce credit availability until the accrued amounts are paid in full. If a Customer reaches its credit limit Union Telecom shall have the right to automatically interrupt the service until the Customer has made partial or full payment of the amounts owed by calling our Customer Service or Collections departments. Union Telecom reserves the right to collect an amount not to exceed one month’s estimated charges as an advance payment for services which will be applied against the subsequent month’s charges and, if necessary, Union Telecom shall have the right to collect a new advance payment for the following month. Union Telecom may require advance payments from any Customer if, in Union Telecom’s sole discretion, such payment(s) will be necessary to secure payment for its services. In case customer reaches and/or surpasses its credit limit, customer authorizes Union Telecom to automatically charge the checking account and/or credit card, at the financial institution name used to pay the initial set-up fee to open Union Telecom’s telephone service account, for payment of services used up to the amount of the customer’s credit limit.
Payments: All payments must be sent to the payment address shown on your billing statement and must include the remittance coupon from your billing statement. Payment is due on the bill’s due date. You must pay in U.S. currency with a single draft or check drawn on a U.S. bank, with a money order in U.S. dollars or by phone using either electronic check, debit card and / or credit card, calling our collections and /or customer service departments.
Provisions and Billing of Service: Service is provided and billed on a monthly basis, for a minimum period of one month. The start of service date is the date on which the Customer accepts Union Telecom telephone service. Usage charges for services are billed in arrears and, if applicable, fixed monthly recurring and non-recurring charges are billed in advance. All applicable government mandated local, state and federal taxes, regulatory and other fees and authorized charges will be applied to bills. The minimum call duration for billing purposes is 1 minute of connected call. All calls will be billed with the per minute rate applicable to the destination number. Union Telecom will bill all calls over 60 seconds with a connection fee. Customers will not be billed with a connection fee for calls under 60 seconds. A service charge may be applied to all completed calls. All calls made from payphones will have a surcharge of $0.99 per call.
Timing of Calls: The chargeable time for a long distance call is determined by the duration of the call. A call is deemed answered for the purpose of calculating chargeable time when network hardware detects a completed connection through answer supervision, in which the local telephone company sends a signal to the switch or software utilizing either digital format or audio tone detection. Unanswered calls will not be billed. Chargeable time ends when the calling or called station hangs up or otherwise terminates the call. Billing increments of 3 minutes will apply for all calls above 1 minute. Calls under 1 minute will be billed as 1 minute.
Bill Discrepancy: Union Telecom strives to provide our valued customers the best service possible. If the Customer has a bill discrepancy, Customer should notify Union Telecom in writing within 15 days after the receipt of your Union Telecom bill. Union Telecom will consider Customer requests for credit for faulty or incorrect connections and for problems experienced by customers in the use of Union Telecom’s services on a case-by-case basis, and will provide reasonable credit in those cases in which determines, in its sole discretion, that the request is justified. It shall be the obligation of the Customer to notify Union Telecom immediately of any service problems for which a credit allowance is desired. NOTHING HEREIN SHALL BE CONSTRUED AS PROVIDING THE CUSTOMER A RIGHT TO ABATEMENT OF ANY PAYMENTS DUE UNDER A BILL.
Customer Obligations: PAYMENT POLICY: Customer acknowledges and agrees that payment is due in full by the due date stated on the bill, unless an additional period for timely payment is required by law, in which case the full period required by law shall apply. A late fee of $9.50, will be added if payment does not arrive by the due date. Customers with Intrastate-only overdue balances will be subject to the appropriate late fee allowed by their state law. Service may be terminated by Union Telecom if full payment is not received within 15 days after the due date. By copy of this letter, Customer hereby authorizes Union Telecom to automatically charge the checking account and / or credit card, at the financial institution name used to pay the initial set-up fee to open Union Telecom’s telephone service account, for payment of bills rendered to the customer by Union Telecom and that have not been pay within 15 days of the bill’s due date.
The Customer further authorizes the financial banking institution to accept these charges to my checking account and / or credit card. For customers paying their bill by credit card, service will be suspended immediately upon notification that the credit card on file is declined or otherwise un-chargeable due to expired information, fraud, charge backs or other such problem types. In the event that any payment is returned, disputed, or unpaid by the customer’s bank for insufficient funds, or otherwise, Customer will pay to Union Telecom up to $40.00 plus the cost of the processing fee from the bank. If termination is required, all services will be deactivated and a termination fee of $15 or 10% of the total account balance, whichever is greater, will be added to the balance due. An administrative fee of $50 will be charged to an account that is past due and placed into collections. This administrative services fee is in addition to any and all fees applicable to delinquent accounts, including, but not limited to the termination fee. Customer remains financially responsible for all charges incurred until such time as service to any telephone line(s) has been removed from Union Telecom, and until written notification of the removal request from customer has been received by Union Telecom.
Customer acknowledges that their local telephone company may assess a service charge for each line changed to the carrier selected by Union Telecom for which customer will be responsible. Customer acknowledges and understands that all rates, plans, billing increments, taxes and service charges are subject to change without notice, including federal, state and Universal Service Fund (USF) surcharges, mandated by the FCC and subject to quarterly changes. USF surcharges will be applied as mandated on a case by case basis. Union Telecom may charge the Customer the following fees and charges depending on the state where the customer resides, area code and access number that it uses:
Telecom Relay Charge of up to 7.5% of the monthly usage; Telecom & Administration Fee up to 12.5% of the monthly usage; a Service Fee of up to 8.1% of the minutes used; a Communications Fee of up to 7.2% of each minute used of Union Telecom’s service; and a long call charge of up to 7.8% for every call longer than three minutes. All of the aforementioned fees and charges are also subject to quarterly changes. For details of each charge customers should call Union Telecom’s Customer Service. Customer agrees to a minimum usage fee of 99 cents for accounts billing less than $15 per month for opting to receive a paper bill rather than online/automatic billing (eBill). This fee will not apply to Customers who agree to allow Union Telecom to bill their charges via eBill. If Customer requests a toll-free number on their account, a monthly recurring fee of 99 cents per toll free number will be charged in addition to usage.
All new accounts shall require an activation fee of $39.50 to cover administrative account opening costs and for risk management of any unpaid balances that the Customer might have accrued when stopping the use of Union Telecom’s service. Should the Customer switch away from Union Telecom prior to using any or the entire $39.50 activation fee, customer shall forfeit such fee to compensate and reimburse Union Telecom for processing costs, which shall be deemed fully earned by Union Telecom. In the event that a customer wishes to cancel the service, considering that the customer has no past due balances, and have been using union telecom services over 12 months,Union Telecom will provide an activation fee refund in the form of a personal PIN equivalent to $50.00. This PIN is valid for long distance call services provided by Union Telecom. By accepting this PIN refund, Union Telecom is released from any claims, issues and/or liability from the respective client.
If customer does not receive the invoice it does not exempt it from its payment obligations, and in such cases is customer responsibility to inquire about the amount it must pay directly to the company by the different means available, including but not limited to company website, by phone or in other channels that the company makes available to its customers for such purpose. If within 30 calendar days from the date of payment, the customer does not manifest any disagreement it shall be deemed ass customer agreement as to pay the billed amount.
If you do not receive the invoice, within 5 days before the payment due date, the customer by any means of communication established by the company, may report such circumstances, in which case the company shall be bound to provide a copy via email or postal mail should be the case. In this regard, if the company did not receive the notice given under this paragraph, assume that customer received its bill.
PAYMENT METHOD: Commercial and residential accounts may be required to pay via credit/debit card if such account is deemed a credit risk. Should a Customer’s order be rejected due to negative information received from the credit agency chosen by Union Telecom, the Customer will receive written notification of such determination. Any and all accounts (commercial or residential) that pay by credit/debit card or via ACH/bank account information may be charged any and all outstanding balances to their financial account at any time, including non-payment fees set forth above. Additionally, accounts using the online billing website may be charged a site maintenance fee. Terms and conditions will be posted on the e-bill website. Union Telecom may charge Customer a reasonable fee for research and any resulting paperwork involved in requests for copies of past bills or other documentation. Union Telecom makes every effort to update its website with regard to rates and fees and when changes occur; however, this information is not always current. Customer understands that if they encounter an increase in rates and fees that are in conflict with the information posted on our website, our current internal price list, government notification or state tariff, if applicable, will govern rather than the website information. A current price list for all rates is always available upon written request.
Access Numbers and Talk Traveling: Union Telecom reserves the right to change access numbers and codes upon notice to customer. Customer assumes responsibility for security of their assigned access codes (PINs) for the Talk Traveling Service and is responsible for any calls made using its access codes. Customer must report stolen PINs to the customer service department immediately. The customer assumes all liability for fraudulent usage of any Union Telecom product. Customer further agrees that if either telephone or access codes are tampered with, compromised, lost or stolen, the customer assumes full responsibility for usage on such lines until Union Telecom is notified of such unauthorized usage. It is the customer’s sole responsibility to notify Union Telecom of any changes in international status regarding telephone or calling card lines. Union Telecom may apply on a case a case basis other charges related to the access numbers it provides including but not limited to Network Access Charge up to $1.99 per month, Recovery Charge up to $0.89 per month, Carrier Cost Recovery up to $1.49 per month, and a Termination Charge up to $0.75 per month. The customer agrees to maintain strict security over long-distance or calling card lines. International call types (mobile, NGN and landline) are rated by foreign, non-U.S. phone companies and are not controlled by Union Telecom.
International call types and rates are subject to change without notice and a complete list may be obtained from Union Telecom upon request. International call types (mobile, landline or NGN) are not disputable by the customer nor will Union Telecom re-rate international calls.
Limitations on Provisioning the Service: Union Telecom reserves the right to refuse or discontinue service immediately without incurring liability: a) For non-payment of any sum owing to Union Telecom after the bill’s due date, including disputed and/or undisputed charges, b) For insufficient or fraudulent information, invalid or unauthorized telephone numbers, credit or debit card numbers, electronic check numbers or pre-arranged account code numbers, c) By reason of any order or decision of a court or other governmental authority which prohibits Union Telecom from furnishing such Service, d) Immediately, upon a Customer exceeding its approved credit limit and where the Customer declines to recharge its account, e) In the event Union Telecom’s underlying carrier or other third party telecommunications service provider discontinues or interrupts their service to Union Telecom for any reason, f) As required by law or government regulation.
The Customer may not transfer its rights or duties under this document without the express written consent of Union Telecom.
Limitations of Liability: UNION TELECOM WILL BE RESPONSIBLE ONLY FOR THE RESALE OF SERVICES IT OFFERS. CUSTOMER UNDERSTANDS THAT UNION TELECOM WILL USE COMMERCIALLY REASONABLE EFFORTS TO PROVIDE SERVICES; HOWEVER, UNION TELECOM MAKES NO GUARANTEE THAT SERVICES WILL BE PROVIDED AND ASSUMES NO LIABILITY DIRECTLY OR INDIRECTLY FOR INTERRUPTION OF SERVICE.
CUSTOMER ACKNOWLEDGES THAT UNION TELECOM SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, SPECIAL, INCIDENTAL OR OTHER DAMAGES WHATSOEVER ARISING FROM ANY FAILURES, INTERRUPTIONS, DELAYS, ERRORS OR DEFICIENCIES OF SERVICES, FACILITIES OR EQUIPMENT PROVIDED BY UNION TELECOM, SUPPLIERS, VENDORS, AFFILIATES, PARTNERS AND SUBSIDIARIES PURSUANT TO YOUR ORDER FOR SERVICE. SINCE DAMAGES WOULD BE DIFFICULT TO DETERMINE IF YOUR SERVICE IS DISRUPTED OR OTHERWISE NEGATIVELY AFFECTED, CUSTOMER AGREES TO ACCEPT NO LIQUIDATED DAMAGES IF THE SERVICE IS DISRUPTED OR OTHERWISE NEGATIVELY AFFECTED.
Customer further agrees to pay any and all costs associated with enforcing this agreement, including but not limited to reasonable attorney and collection fees, court costs, and costs of appeal. Customer holds Union Telecom blameless and assumes full responsibility for any and all calls, authorized or unauthorized, that are placed via customer’s subscribed local access lines and/or toll free lines. Customer is also financially responsible for all data customer enters into the sign up form, e-bill site and verbal or written correspondence to Union Telecom, including incorrect information and telephone lines.
Indemnification. Customer shall defend, indemnify and hold harmless Union Telecom, its officers, directors, employees and agents from any claims expense, including reasonable attorney’s fees, related to any breach of this Agreement, use of Customer’s account or in connection with the placement or transmission of any message, information, software or other content using the Services. Union Telecom shall give written notice of any such claim, action or demand within a reasonable time. Union Telecom shall be defended by attorneys of their choice at Customer’s expense.
Law & Arbitration. This Agreement shall be governed by and construed in accordance with the laws of the state of Florida. Any controversy or claim between the parties arising out of or related to this Agreement shall be settled by arbitration before a single arbitrator under the then current rules of the American Arbitration Association. The arbitration shall be held in Miami-Dade County, Florida. The decisions and aware of the arbitrator shall be final and binding and the aware so rendered may be entered in any court having jurisdiction thereof.
UNLIMITED SERVICE SPECIFIC TERMS AND CONDITIONS:
Unlimited $20 ILD Service
1. UNLIMITED USE DOES NOT MEAN UNREASONABLE USE. To ensure that all consumers have access to reliable ILD services, You may not use the Service in a manner that interferes with another Elite Telecom consumer’s use of the Service or disproportionally impact’s network resources. The Unlimited ILD Services is provided solely for live dialogue between, and initiated by, two individuals for personal use and not for commercial use or resale.
2. This ILD Service may not be used for any other purposes, including, but not limited to, loaning or renting Your handset to third parties, conference calling, monitoring services, data transmissions, transmission of broadcasts, transmission of recorded material, interconnection to other networks, telemarketing, autodialed calls, other commercial uses, or other connections that do not consist of uninterrupted live dialogue between two individuals.
3. Elite Telecom’s Unlimited ILD Service allows You to place calls to select destinations internationally. It will not allow You to place calls to all destinations. Elite Telecom’s Unlimited ILD Service is not a substitute for all international services. This service excludes calls to higher cost cellular, non-geographic and premium numbers. The destinations which are available may change without notice. If You want to call a destination or telephone number which is not part of this Unlimited ILD Service, You may purchase and utilize a prepaid international plan with services provided by Union Telecom. 4. Elite Telecom will presume certain usage, dialing, or calling patterns to indicate that You are using the ILD Service for Your personal use and We reserve the right to suspend, terminate or restrict Your Services without prior notice. If You believe that We are in error, You may contact Customer Service at (800) 710-3985 and depending on the circumstances We may reactivate Your Unlimited ILD Service. However, if the usage, dialing or calling patterns We deem connote non-personal use (as stated above) continues, We reserve the right to suspend, terminate or restrict Your Services within no prior notice and not allow You to reactivate Service
5. To minimize unreasonable use, each Account will be allowed to call up to 5 unique destination numbers per thirty-one (31) day period. The number of personal use calls to these unique destination numbers is not limited and automatically resets when the Account is renewed.
6. Originating phone number must be an active Union Telecom subscriber.
7. Consumers can determine the destinations included in this Service by providing the clerk with the actual phone numbers they wish to call or check themselves at https://uniontelecomusa.com.
8. Unlimited plan expires thirty-one (31) days after Account has been funded or renewed.
